TERMS AND CONDITIONS WHEN USING THE NVS PHARMACY WEBSITE

Please read these Terms & Conditions carefully and print a copy for reference. By using the Site you agree to accept these Terms & Conditions. If you do not wish to accept these Terms & Conditions, please do not use the Site.

DEFINITIONS

"The Site" means www.nvspharmacy.co.uk
"Products " means any goods or services sold or purchased from the Site.
"Customer" means visitor to or purchaser of products from the Site.

Please note that Products sold on the Site and promotions are available in mainland United Kingdom and  worldwide.

If any part or parts of these Terms and Conditions is or are deemed invalid, void or unenforceable, then that part or those parts will be considered severable from these Terms and Conditions thereby not preventing the remainder from being enforceable or effective.

These Terms and Conditions may be revised at any time and NVS reserves the right to do so. The Customer is therefore advised to keep up to date with the contents of these Terms and Conditions, as revisions will be binding upon the Customer.

Nothing in these Terms and Conditions will reduce the Customer's statutory rights relating to faulty or mis-described Products. For further information about statutory rights, please contact your local authority Trading Standards Department or Citizen's Advice Bureau.

Governing Law
Use of this Site and any purchase from this Site of any Products will be governed by English Law and will be deemed to have occurred in mainland United Kingdom.

Sales and Purchase Access to and use of the Site and all transactions relating to the sale and purchase of any products from the Site are governed wholly by these Terms & Conditions.

When the Customer receives confirmation of order, this is only to indicate that NVS has received the order. It does not indicate that a contract exists between NVS and the Customer. NVS will indicate acceptance of the order, and hence a contract between NVS and the Customer, when NVS sends the Customer an invoice. This term is included to protect NVS in the case that a mistake has been made in pricing, NVS has inadvertently under-priced goods, or NVS is no longer able to supply a particular Product for some reason. In the case of a change of price, NVS will always contact the Customer first to ensure that the price is acceptable.
Shipping and Handling All prices are quoted in pounds Sterling and are inclusive of VAT unless otherwise specified.

All item prices are exclusive of delivery and packaging, unless otherwise stated. Details of delivery charges our found in the "Delivery Charges" section of the Site.

Prices are correct at the time of order only and relate to purchases made through the Site only. All orders for Products are subject to availability and NVS reserves the right to refuse to supply any Customer.
Payments Payment must be made in pounds Sterling only by major credit or debit cards as listed: Visa, Delta, Master Card, Maestro, and Solo. Payment will be debited from the Customer's account when the Products are ordered from NVS.

Payment Security
NVS does not store any credit card details or other sensitive information at nvspharmacy.co.uk. All transactions are processed by Protx, who use bank-approved software and the highest level of encryption to ensure that your credit card details are kept secure at all times. The Protx SSL certificate may be viewed by double clicking on the padlock at the bottom of the Protx payment pages.

NVS undertakes to take all reasonable care, in so far as it is possible to do so, to keep all details of Customer orders and payments secure, however, in the absence of negligence on NVS?s part, NVS cannot be held liable for any loss incurred by the Customer from any third party which procures unauthorised access to any data provided by the Customer when accessing or ordering from the Site.
Passing of Property NVS will retain the property in the Products until full payment has been made by the Customer and has been received by NVS.
Passing of Risk Any risk associated with the installation or use of the Products passes fully to the Customer on delivery, as set out in DELIVERY below.

Delivery Charges
A flat rate of £1.75 will apply only to UK Mainland delivery addresses. Any UK offshore addresses, including the Channel Islands, Scottish Islands or Isle of Man may incur additional charges which will be confirmed by subsequent email following receipt of an order.

Any date or period for delivery will be considered as indicative only, although it is NVS's policy to try to fulfil all orders within 10 working days; items weighing more than 25 kilograms might take longer to deliver.

NVS will inform the Customer of any delays within 48 hours of notification of such to NVS.

Any Products not available at the time of receipt of the Customer order will be sent to the Customer as soon as possible after delivery from NVS's suppliers. EW cannot be held responsible for delays in the delivery caused by NVS's suppliers or any other third party.

All Products will be sent by courier. All deliveries must be signed for upon receipt. Unless agreed otherwise with NVS, deliveries will only be made to the address of the person who is the holder of the credit or debit card used to purchase the Products.

The Customer bears the risk once the Products have been signed for.
Acceptance The Customer will inspect the Products within 3 days of receipt and will be deemed to have accepted the Products unless NVS is notified within 7 working days of receipt that the product has arrived damaged, items on the delivery note are missing, or the Customer notifies NVS in accordance with paragraph 10 below that the Products are faulty. If no such action is taken, NVS will consider the Products being as described, of satisfactory quality and fit for their purpose, and will not be obliged to accept any rejection or cancellation at a later date. The Customer's statutory consumer rights are not affected.
Right to Cancel The Customer has the right to cancel their contract with NVS at any time up to the dispatch of the goods. In doing so the Customer will receive a full refund from NVS for the purchase price and any delivery charge already paid by the Customer.

Under the Consumer Protection (Distance Selling) Regulations 2000, the Customer has the right to cancel an order within seven working days (i.e. excluding weekends and Bank holidays), starting the day after receipt of the Products, without giving a reason. This is known as the 'cooling off' period. Cancellation must be made in writing to NVS, either by post or by email.

On cancellation, the Customer has to return the Products to NVS at the Customer's own expense and to take reasonable care of the Products at all times. The Customer is also responsible for ensuring the Products are received by NVS and not damaged in transit. If the Products are not returned as required above, NVS may at its discretion arrange for the Products to be collected from the Customer and returned to NVS.

NVS will give a refund for the value of the Products within 30 days of the date of cancellation. NVS will make an additional charge for any costs incurred by NVS in collecting the Products from the Customer and returning them to NVS. Such a charge will be the only charge that will be levied by NVS.

Data collected by this site is used to:
a. Take and fulfil customer orders
b. Administer and enhance the site and service
c. Only disclose information to third-parties for goods delivery purposes

Privacy
NVS is committed to protecting the Customer's privacy. NVS will only use the information collected about a customer in a lawful manner in accordance with the DATA Protection Act 1998.

NVS does not disclose Customer information to third parties other than when order details are processed as part of the order fulfilment. In this case, the third party will not disclose any of the details to any other third party.

Cookies are used on the Site to keep track of the contents of the Customer's shopping cart. The Customer can opt to turn off cookies within their browser by going to 'Tools | Internet Options | Privacy' and selecting to block cookies. By turning off cookies, the Customer may be unable to place orders or benefit from the other features on the Site that use cookies.

Faulty Products Any Product that was faulty at the time of sale may be returned for free repair, replacement or refund provided the Customer has the original receipt or alternative proof of purchase and the faulty Product is returned complete with all components.
